These terms govern your use of the Adaptive Coordination Technologies website, the Lessons Learned Navigator, and any related tools we make available (together, the "Service"). Please read them carefully.

1. Acceptance of these terms
By accessing the Service, creating an account, or otherwise using any part of it, you agree to be bound by these terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization. If you do not agree to these terms, do not use the Service.
2. The Service
The Service provides search, filtering, and summarisation tools over publicly available infrastructure project delivery information, along with related research links. We may add, change, suspend, or discontinue any part of the Service at any time without liability to you.
3. Accounts and security
Some features require an account. You agree to provide accurate information, to keep your credentials confidential, and to be responsible for all activity that occurs under your account. Notify us promptly at team@integrateact.com if you suspect unauthorised access. We may suspend or terminate accounts that violate these terms.
4. Acceptable use
You agree not to:
- scrape, harvest, or bulk-download the Service other than through functionality we provide;
- resell, sublicense, or redistribute the Service or its compiled content as a substitute product;
- attempt to gain unauthorised access to the Service, other accounts, or our infrastructure;
- interfere with or place undue load on the Service, or circumvent any access restriction or rate limit;
- use the Service in violation of any applicable law or regulation.
5. Data sources and no government affiliation
Lessons-learned content is compiled from publicly available Federal Highway Administration (FHWA) sources and other public records. Those underlying materials remain the work of their respective authors and agencies.
Adaptive Coordination Technologies is an independent company. It is not affiliated with, endorsed by, sponsored by, or approved by the FHWA, the U.S. Department of Transportation, any state department of transportation, or any other government agency. References to any agency, project, or program are for identification and informational purposes only.
6. Not professional advice
The Service is an informational research aid. It does not constitute engineering, architectural, construction, procurement, financial, or legal advice, and it does not create any professional relationship between you and us. Nothing in the Service is a substitute for the judgement of a licensed professional.
Source records may be outdated, incomplete, superseded, or inapplicable to your circumstances. Specifications and standards change. You are solely responsible for independently verifying any information against the current governing specifications, codes, and contract documents before relying on it for any project decision.
7. Intellectual property
The Service's software, design, organisation, and compiled presentation are owned by Adaptive Coordination Technologies and protected by intellectual property laws. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes. All rights not expressly granted are reserved. Public-domain government records remain in the public domain.
8. Disclaimer of warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE, COMPLETE, CURRENT, OR RELIABLE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADAPTIVE COORDINATION TECHNOLOGIES AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR PROJECT COSTS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS, SO SOME MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify and hold harmless Adaptive Coordination Technologies and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these terms, or your violation of any law or third-party right.
11. Termination
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these terms or to protect the Service. Sections 5 through 10 survive termination.
12. Changes to these terms
We may update these terms from time to time. Material changes will be reflected by the "last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
13. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located there. If any provision is held unenforceable, the remaining provisions remain in full force.
